Future of Kratom Legislation: Trends & Predictions

History of Kratom Legislation

Kratom is centuries old. Made from the leaves of the Mitragyna speciosa tree, which is native to Southeast Asia, kratom has been used for generations in folk healing, home remedies, and cultural rites. 

Kratom leaves are a rich source of natural alkaloids called mitragynine and 7-hydroxymitragynine. Users say that when they consume kratom, these alkaloids induce a pleasant feeling of enhanced vitality, increased motivation, or overall peace and tranquility, depending upon the strain and dose.

Kratom was first introduced to the Western world in 1839 when it was described by the Dutch botanist Pieter Korthals. However, it wasn’t until the 1990s that kratom use started to become popular beyond Southeast Asia. Unfortunately, as with many herbal supplements and botanical products, backlash also started to rise. 

In 2016, the United States Drug Enforcement Agency (DEA) attempted to reclassify kratom as a Schedule I drug. With support from the Food and Drug Administration, this motion would have rendered kratom illegal and placed it in the same category as harmful controlled substances like heroin. Thankfully, kratom advocates successfully lobbied Washington, and the DEA rescinded its attempt.

Current Legal Trends

Currently, kratom remains federally unregulated in the United States. Its legal status varies from state to state. Unfortunately, this makes it more difficult for both kratom consumers and the kratom industry. Without nationwide protection, it’s challenging to fund scientific research into the potential health benefits of kratom. It’s also harder to impose industry-wide quality standards and safe manufacturing practices.

In the United States, many states have passed a piece of legislation called the Kratom Consumer Protection Act. This legislation bans synthetic kratom products that have been adulterated with other substances, creates age restrictions for kratom, and paves the way for research funding. 

As of 2024, states with a Kratom Consumer Protection Act (KCPA) include Arizona, Georgia, Nevada, and Utah. Other states, such as California, have pending KCPA legislation.

States where kratom is illegal include:

  • Alabama
  • Arkansas
  • Indiana
  • Rhode Island
  • Vermont
  • Wisconsin

There is also KCPA legislation pending at the federal level. Known in the Senate as bill S.3039 and in the House as H.R. 5905, this act would require the Food and Drug Administration (FDA) to hold hearings about kratom’s health impact and safety. It would also grant kratom the same regulatory status as food and dietary supplements. This would protect kratom products from unfair, harsh restrictions.

Legislation isn’t the only path to establishing necessary kratom protections. In September 2024, the American Kratom Association petitioned the FDA Commissioner to convene a public stakeholders meeting and listen to the voices of real kratom users, as well as scientists and policy experts who have studied kratom. Although the FDA has not approved kratom or its alkaloids for any medicinal purpose, advocates hope that the agency will one day revise its position with further evidence-based research. 

Future Kratom Laws

There’s one point where kratom advocates and their opponents can agree: no one knows the future of kratom legislation. 

But kratom is gaining momentum. More and more people are discovering the potential benefits of this potent plant. Students and office workers use kratom to promote concentration. Fitness fanatics use it as a pre-workout to boost vitality and stamina. And many more individuals enjoy a dose of kratom to unwind after a long day or simply bring more balance and comfort to their lives.

As long as kratom remains unregulated at the federal level, consumers risk challenges that may impact their access to safe, pure products. That’s why advocates will continue working to pass the Kratom Consumer Protection Acts at the state and federal levels. Hopefully, the increasing awareness around kratom will encourage lawmakers to pass these legal protections.

It’s likely that new research will also affect future laws. More long-term studies are needed to understand how kratom may or may not support mental and physical health, as well as how it may impact activities such as driving
